How do you check if a bankruptcy lawyer is licensed and in good standing?
To check if a lawyer is licensed, look the lawyer up in the attorney search run by the bar or licensing body of the state where they say they are admitted, and make sure the license is active. Many of these searches also show discipline: California's, for example, gives the license status and the lawyer's disciplinary and administrative history. Then ask whether the lawyer may appear in the bankruptcy court that will hear your case, because each federal court's own rules decide that.1 2 3 4

What should you confirm before you hire a lawyer?
There are separate questions here, and a yes to the first does not answer the others.
| What to check | Where to check it | Why it matters |
|---|---|---|
| The state license, its current status and any discipline5 1 2 3 | The attorney search of the bar or licensing body of the state where the lawyer says they are admitted | Lawyers must follow state ethics rules, people sometimes impersonate lawyers, and some searches list discipline |
| Whether the lawyer may appear in your bankruptcy court4 6 | The lawyer, and the court's own website and local rules | Each federal court's rules decide which lawyers may appear before it |
| The fee, in writing5 7 8 | The fee agreement, and later the fee statement filed in your case | A debtor's attorney must file a statement of the compensation paid or agreed with the court |
How do you use a state attorney license lookup?
Lawyers must follow state ethics rules, and a license is checked with the bar or licensing body of the state that issued it. So the first step is always to ask the lawyer which state licensed them.5 1
California shows what a state body offers. The State Bar of California tells the public to verify that anyone they hire is licensed, and its Attorney Search gives the status of the license and the lawyer's disciplinary and administrative history. Disciplinary records are listed on the lawyer's public profile there. Other states run their own searches, so the details differ.1 2 3
- Ask which state licensed the lawyer and the exact name they are licensed under.
- Find that state's attorney search on the licensing body's own website, not through a link the lawyer or an advertisement gave you.
- Check that the license is active. A suspended or disbarred attorney is not authorized to practice.1
- Contact the lawyer using the details the licensing body lists. The State Bar of California says lawyers must keep those details up to date, and warns that scammers impersonate real lawyers and firms, take payment and disappear.1
Some states also certify specialists. The State Bar of California certifies attorneys in certain areas of law and has a separate search for them. Certification is an extra credential; the license is what lets a lawyer practice.2 3 1
Can any licensed lawyer appear in your bankruptcy court?
Not automatically. In federal courts, parties may conduct their cases personally or through counsel as the rules of each court permit. A state license and permission to appear in a particular federal court are therefore separate questions.4
Ask the lawyer directly: which court would my case be filed in, and are you admitted to practice there? You can then read that court's own rules. Local rules are posted on each court's website, and the federal courts publish a page of links to the individual court sites.6 9
This matters most with firms that advertise in many states. If a lawyer plans to work with another lawyer near you, ask who will actually appear in your case. The FTC suggests asking any lawyer who will do most of the work.5
How is a bankruptcy lawyer's fee kept honest?
A bankruptcy lawyer's fee is not a private matter between the two of you. Any attorney who represents a debtor in a bankruptcy case, or in connection with one, must file with the court a statement of the compensation paid or agreed to be paid and where the money came from. The statement is due within 14 days after the case begins unless the court sets another time.7 8
The court can act on it. If the compensation exceeds the reasonable value of the services, the court may cancel the fee agreement or order the excess returned.7 8
So ask for the fee in writing at the start, as the FTC advises for any lawyer. The State Bar of California warns about anyone who rushes you to pay the entire fee immediately, especially in cash, by wire or through an encrypted messaging app.5 1
What if the person helping you is not a lawyer?
Then different rules apply. A bankruptcy petition preparer is a person or business not authorized to practice law that prepares bankruptcy petitions. Preparers may only enter information into forms, and they may not give legal advice or help you in bankruptcy court.10 11 6
A preparer must sign every document they prepare and may not use the word "legal" or similar terms in advertisements. Someone who offers legal advice but cannot show a license is a reason to stop and check.11
What can a license check not tell you?
It cannot tell you whether the lawyer is experienced in consumer bankruptcy or will handle your case with care. A license is the minimum. The rest comes from talking with the lawyer.
The FTC suggests planning to talk with more than one lawyer before hiring, and asking who will do most of the work, what the fees are for each person who works on the case and how long it could take.5
Common questions
Does a state license mean the lawyer can appear in my bankruptcy court?
Not by itself. Each federal court's own rules decide which lawyers may appear before it, so ask the lawyer whether they are admitted in the court where your case would be filed.4
How do I find out if a lawyer has been disciplined?
Check the attorney search of the state that licensed the lawyer. In California, for example, it shows the license status and the lawyer's disciplinary and administrative history, and disciplinary records are listed on the public profile.2 3
Where do I complain about a lawyer?
The FTC says that if you cannot resolve a problem with your lawyer, or believe the lawyer did something wrong, you can consider filing a complaint with your state or local bar association.5
