Can a bankruptcy court give you more time to file something?
Often, yes. Under Bankruptcy Rule 9006, a court may extend a deadline for cause when the request is made before the period expires. After the period has expired, it takes a motion and a showing that the failure to act resulted from excusable neglect. Some deadlines cannot be extended, and others can be extended only as their own rule allows.1
Get the Pro Se GuideBankruptcy deadlines are firm, but the rules let a court extend many of them. This guide covers the general rule, the deadlines it comes up for most, how days are counted, and the limits on what a court can do.

Why does it matter whether you ask before or after the deadline?
The general rule treats the same request in different ways depending on its timing. A request made before the period expires may be granted for cause. A request made afterward needs a motion, and the court has to find that the failure to act in time resulted from excusable neglect.1
In both situations the rule says the court may extend the time. It is a decision for the judge, not something the filer is entitled to, and the rule does not say that filing a request pauses the deadline while the court considers it.1
Which deadlines does this come up for?
The general rule is only the starting point. Several of the deadlines an individual filer meets have their own extension language, and the rule for that deadline controls. The table summarizes what the national rules and the Bankruptcy Code say. Local rules and court orders can add to it.1
| Deadline | What the rule says | Extension |
|---|---|---|
| Schedules, statement of financial affairs, pay stubs and means test forms2 | Due with the petition or within 14 days after it is filed | The court may extend the time on motion and for cause |
| All of the required information, in an individual Chapter 7 or Chapter 13 case3 | If it is not filed within 45 days after the petition, the law says the case is automatically dismissed, effective on the 46th day | If the debtor asks within those 45 days, the court may allow up to 45 more days when it finds the extension justified |
| Chapter 13 plan4 | Due with the petition or within 14 days after it is filed | Not extended except for cause and on notice as the court orders |
| Financial management course certificate in Chapter 72 5 6 1 | Due within 60 days after the first date set for the meeting of creditors, unless the course provider has already notified the court | Only as the rule for that certificate allows |
| A response to a motion7 8 1 | The national rule requires reasonable notice and an opportunity to be heard; the notice, the local rules or the court set the actual dates | Governed by the general rule, the local rules and the judge |
How are the days counted?
When a deadline is counted in days, the day of the event that starts the period is left out and every day after it is counted, including weekends and legal holidays. If the last day is a Saturday, Sunday or legal holiday, the period runs until the end of the next day that is not one.1
Working out the date in a specific case is the filer's job. One bankruptcy court's published guide lists computation of deadlines among the things clerk's office staff cannot provide, alongside legal advice and direction on what to do next.9
How is a request for more time made?
The rules describe the request in general terms, and each court has its own practice on forms, hearings and who must be notified. The court's local rules, posted on its website and available at its intake counter, are where those details live.10
- The standard the court applies is cause before the deadline, and excusable neglect after it.1
- A party without a lawyer must sign every document filed with the court. By presenting it, the party certifies that it is not presented for an improper purpose such as delay and that its factual contentions have evidentiary support.11
- For the time to file schedules and statements, the rule calls for notice of the motion to the United States trustee and other parties the court orders.2
Clerk's office staff can explain the court's procedures and how to get its forms. They cannot say what to write in a motion.9
What are the limits on extra time?
Some periods are outside the court's power to extend, and the rule lists them by number. Others can be extended only as the rule for that deadline permits.1
The law on required documents has its own ceiling. If an individual in a voluntary Chapter 7 or Chapter 13 case does not file all of the required information within 45 days after filing the petition, the law says the case is automatically dismissed, effective on the 46th day. The extra time the court may allow on the debtor's request is capped at 45 more days, and the request has to be made within the first 45.3
Delay can also become a reason to end a case. A court may dismiss a Chapter 7 case for cause, and the causes listed in the law include unreasonable delay by the debtor that is prejudicial to creditors. In Chapter 13, the listed causes include failure to file a plan on time and failure to start making timely payments.12 13
What if the deadline has already passed?
A late request is still possible under the general rule, but it requires a motion and a finding of excusable neglect, and it does not reach the deadlines the rule excludes.1
What a missed deadline means for a particular case, and what can be done about it, depends on which deadline it was and what the docket shows. That is legal advice, which court employees and judges are prohibited by law from giving. The federal courts say people who cannot afford an attorney may qualify for free legal services, and suggest contacting a state or local bar association for help finding them.10 14 15
Common questions
Can every bankruptcy deadline be extended?
No. The general rule lists periods the court must not extend, and others that can be extended only as their own rule allows.1
Does a weekend or holiday change the last day?
If the last day of a period counted in days is a Saturday, Sunday or legal holiday, the period runs until the end of the next day that is not one. Weekends and holidays in the middle of the period are counted.1
Will the clerk tell me when my deadline is?
Staff can give public information from the case docket. One bankruptcy court's published guide says its staff cannot compute deadlines in a case or interpret court orders.9
What happens if the required documents are never filed?
The official instructions say a case may be dismissed if the required forms are not filed on time. For individuals in Chapter 7 and Chapter 13, the law provides for automatic dismissal when all of the required information has not been filed within 45 days after the petition.14 3
