Schedules
Bankruptcy schedules are the detailed lists a debtor files with the petition, or shortly after it, showing the debtor's assets, liabilities and other financial information. 1
Talk to a lawyerHow do bankruptcy schedules work?
The rules require schedules of assets and liabilities, a schedule of current income and expenditures, a schedule of executory contracts and unexpired leases, and a statement of financial affairs. They are prepared on the Official Forms. 2
In a case you start yourself, they are due with the petition or within 14 days after it is filed. The court may extend the time on a motion that shows cause. 2
You sign the forms under penalty of perjury, confirming that the information is complete and accurate. A false statement or hidden property can lead to fines, prison or both. 3
Missing schedules can end a case. If an individual in a voluntary Chapter 7 or Chapter 13 case does not file all of the required information within 45 days after filing the petition, the case is automatically dismissed effective on the 46th day. If the debtor asks within those 45 days, the court may allow up to 45 more days when it finds justification. 4
Mistakes can be fixed. A debtor may amend a schedule at any time before the case is closed, and must give notice of the change to the trustee and anyone affected by it. 5
